WELCOME TO SIDE BY TAIL
These Terms of Service (“Terms”) govern your access to and use of the Side By Tail website, online store, products, services, content, and related features collectively referred to as the “Services.”
The Services are operated by Christine Charles, an individual operating under the trade name Side By Tail.
In these Terms, “Side By Tail,” “we,” “us,” and “our” refer to Christine Charles operating under the trade name Side By Tail.
By accessing or using the Services, or by placing an order through the Store, you agree to these Terms together with our:
• Privacy Policy;
• Shipping Policy;
• Return & Refund Policy; and
• any product-specific conditions or disclosures presented before purchase.
If you do not agree to these Terms, please do not use the Services or place an order.

Side By Tail is an online retail store offering products for dogs and dog owners.
Products may be sourced, stored, prepared, manufactured, printed, shipped, or fulfilled by selected third-party suppliers and fulfillment partners.
Regardless of which partner prepares or ships a product, Side By Tail remains your point of contact for orders placed through the Store.
2. ELIGIBILITY TO USE THE SERVICES
By using the Services or placing an order, you represent that you are legally capable of entering into a binding contract under the laws applicable to you.
If you use the Services on behalf of another person or organization, you represent that you have the authority to act on their behalf.
You may not use the Services:
• for any illegal, fraudulent, or unauthorized purpose;
• in violation of applicable laws or regulations;
• to interfere with the security or operation of the Store; or
• to transmit malicious software, viruses, or harmful code.
3. HOW AN ORDER IS PLACED
The product pages allow you to review the main characteristics, available options, price, and other relevant information concerning a product.
Before submitting an order, the checkout process allows you to review and, where necessary, correct information including:
• the products selected;
• quantities;
• size, color, or other variants;
• contact details;
• billing information;
• shipping address;
• shipping method; and
• the total amount payable.
By selecting the final payment or order button, such as “Pay now,” you submit your order and authorize the applicable payment.
The contract for your purchase is generally concluded when:
• you submit the order;
• your payment is successfully authorized or accepted; and
• an electronic order confirmation is issued.
We will send an electronic confirmation to the email address provided during checkout.
The order remains subject to the limited cancellation rights described in these Terms, including in cases of product unavailability, suspected fraud, payment failure, an obvious error, or an unavailable shipping destination.
4. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to describe and display products accurately, including their:
• main characteristics;
• intended use;
• dimensions;
• materials;
• colors;
• sizing;
• weight limits;
• care information; and
• available variants.
However, the appearance of a product may vary slightly due to:
• screen and device settings;
• lighting;
• photographic conditions;
• reasonable manufacturing variations;
• material variations; or
• differences between production batches.
Measurements may be subject to reasonable manufacturing tolerances.
Certain lifestyle or contextual images may be used for illustrative presentation purposes. Customers should review the product description, specifications, measurements, variant images, sizing information, compatibility information, and product-specific restrictions before purchasing.
Where there is a material inconsistency between an illustrative lifestyle image and the written product specifications, the written specifications and product-specific information will be used to determine what was offered for sale.
Nothing in this section limits your rights where a product is materially different from its description, damaged, defective, or incorrectly supplied.
5. SIZING AND PRODUCT SUITABILITY
Customers are responsible for reviewing all available measurements, sizing charts, weight limits, compatibility information, and intended-use information before ordering.
For pet products, customers should measure their pet carefully and compare those measurements with the size information provided.
Breed references, where provided, are illustrative only and do not guarantee that a product will fit every animal of that breed.

6. PRODUCT AVAILABILITY
All products and variants are subject to availability.
Inventory information may be provided or updated by suppliers and fulfillment partners and may occasionally change before the Store is updated.
We may, where reasonably necessary and permitted by law:
• limit available quantities;
• discontinue a product or variant;
• modify product availability;
• restrict sales to particular destinations; or
• cancel an unavailable item or order.
If a product becomes unavailable after an order is placed and we cannot fulfill it, we will notify you and refund the amount paid for the affected item, including any shipping amount specifically attributable to that item where applicable.
7. ORDERS AND CUSTOMER INFORMATION
When placing an order, you are responsible for ensuring that the information provided is complete and accurate, including:
• your name;
• email address;
• telephone number, where requested;
• billing information;
• shipping address;
• products and quantities selected; and
• product options such as size or color.
Please review all information before submitting the order.
We may contact you if additional information is reasonably necessary to process, verify, fulfill, or deliver your order.
Failure to provide accurate or complete information may delay or prevent fulfillment.
8. RIGHT TO REFUSE OR CANCEL AN ORDER
We may refuse or cancel an order where reasonably necessary, including in cases involving:
• product unavailability;
• suspected fraud or unauthorized activity;
• payment authorization failure;
• an obvious pricing, product, or listing error;
• an incorrect or incomplete address;
• shipping restrictions;
• quantities that reasonably appear intended for unauthorized resale;
• abuse of a promotion, refund procedure, or payment system; or
• a violation of these Terms.
We will not cancel an order for arbitrary or discriminatory reasons.
If we cancel all or part of an order after payment has been collected, we will notify you and refund the applicable amount for the cancelled item or portion of the order.
9. PRICES AND CURRENCY
Unless otherwise stated, all prices displayed on the Store are in U.S. dollars (USD).
Prices may change without prior notice. A price change will not ordinarily affect an order already placed and accepted.
The product price, applicable shipping charge, taxes, discounts, and total amount payable will be displayed during checkout before the order is submitted.
Your bank, card issuer, or payment provider may apply currency-conversion charges, international transaction fees, or other charges under its own terms. Such charges are not imposed or controlled by Side By Tail.
10. PRICING AND LISTING ERRORS
We make reasonable efforts to ensure that prices, promotions, descriptions, images, and availability information are accurate.
Occasionally, an obvious error may occur.
If an obvious pricing, product, availability, or listing error affects an order, we may contact you before fulfillment to:
• explain the error;
• provide corrected information;
• request confirmation that you wish to proceed; or
• cancel the affected item or order.
If the affected item or order is cancelled after payment has been collected, we will refund the applicable amount.
Nothing in this section permits Side By Tail to engage in misleading or deceptive pricing practices.
11. PAYMENTS
Payment must be made using one of the payment methods available at checkout.
Payments may be processed by Shopify Payments or another third-party payment provider.
By submitting payment information, you represent that:
• you are authorized to use the selected payment method;
• the payment information is accurate; and
• you authorize the charges associated with the order.
Payment transactions may be subject to security checks, authorization procedures, fraud-prevention measures, and additional terms imposed by the applicable payment provider.
Side By Tail does not directly control the independent payment systems operated by third-party payment providers.
12. TAXES
Applicable sales taxes or other taxes may be calculated and collected where required by law.
Tax obligations may depend on the destination of the order and the applicable legal requirements.
Any tax collected by Side By Tail as part of your purchase will be displayed at checkout.
13. SHIPPING DESTINATIONS
Side By Tail currently ships to:
• the 48 contiguous United States; and
• Washington, D.C.
We do not currently ship to:
• Alaska;
• Hawaii;
• U.S. territories; or
• APO, FPO, and DPO addresses.
Shipping availability may also vary by product, address type, fulfillment location, and carrier.

14. SHIPPING AND DELIVERY
Products may be fulfilled from different locations and may arrive:
• in separate packages;
• from different fulfillment locations;
• on different dates; and
• with separate tracking numbers.
Processing and delivery estimates vary depending on the product, availability, destination, fulfillment location, and carrier.
Estimated delivery information may be displayed on the relevant product page, during checkout, in the Shipping Policy, or in order communications.
Delivery dates and timeframes are estimates unless expressly stated otherwise.
We make reasonable efforts to ensure that any delivery estimate communicated to customers is based on the information reasonably available to us.
If we cannot ship an item within the timeframe communicated at the time of purchase, we will provide updated information and, where required by applicable law, offer you the option to:
• accept the revised timeframe; or
• cancel the affected unshipped item and receive a prompt refund.

• multiple packages;

• delays;
• lost packages;
• packages marked as delivered;
• incorrect addresses; and
• damaged shipments.
15. ORDER CHANGES AND CANCELLATIONS
Orders may enter processing shortly after they are placed.
If you wish to change or cancel an order, contact us as soon as possible at support@sidebytail.com.
We will make reasonable efforts to accommodate your request, but a change or cancellation cannot be guaranteed after:
• payment has been processed;
• the order has entered fulfillment;
• a personalized product has entered production; or
• the order has shipped.
If an order has already shipped, the applicable return procedure may need to be followed.
This section does not affect rights concerning delayed, unavailable, or unshipped items under applicable law.
16. RETURNS, REFUNDS, AND EXCHANGES
Returns, refunds, and exchanges are governed by our Return & Refund Policy.
For eligible products, a return request must be submitted within the period specified in that policy.
Certain products may be designated as:
• final sale;
• personalized;
• made to order;
• hygienic or personal-care products;
• non-returnable; or
• otherwise subject to product-specific return restrictions.
Any applicable restriction will be disclosed before purchase or in the Return & Refund Policy.
Do not return a product without first contacting Side By Tail and receiving the appropriate instructions.
Some returns may require a Return Merchandise Authorization, also known as an RMA, and must be sent to a specific address.
The return address may differ from the address shown on the original shipping package. Products sent to an unauthorized or incorrect address may be refused or may not qualify for a refund, subject to applicable law.

17. DAMAGED, DEFECTIVE, INCORRECT, OR MISSING ITEMS
Please inspect your order promptly after delivery.
If:
• a product arrives damaged or defective;
• you receive an incorrect product;
• an item is missing; or
• the product is materially different from its description,
please contact us following the procedure described in our Return & Refund Policy.
We may request reasonable documentation to investigate the issue, including:
• your order number;
• a description of the issue;
• photographs of the product;
• photographs of the packaging; and
• a photograph of the shipping label.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded.
18. THIRD-PARTY FULFILLMENT PARTNERS
Side By Tail works with third-party:
• suppliers;
• manufacturers;
• print-on-demand providers;
• warehouses;
• shipping carriers; and
• fulfillment partners.
These partners may process information and perform activities reasonably necessary to manufacture, prepare, fulfill, ship, track, or otherwise service an order.
Their involvement does not require you to contact them directly concerning your Side By Tail order.

19. PROMOTIONS AND DISCOUNT CODES
From time to time, Side By Tail may offer promotional codes, discounts, free-shipping offers, or other promotions.
Promotions may:
• have an expiration date;
• be limited to particular customers or destinations;
• exclude certain products;
• require a minimum purchase amount;
• be limited to one use per customer or order; or
• be subject to additional conditions disclosed with the offer.
Promotional offers cannot be combined unless expressly stated.
We may modify or withdraw a promotion before an order is placed, subject to applicable law.
We may reject the fraudulent, unauthorized, or abusive use of a promotional offer.
20. PERSONAL USE AND RESALE
Unless otherwise agreed in writing, products purchased through Side By Tail are intended for personal use.
We may limit or cancel quantities that reasonably appear to be purchased for:
• unauthorized commercial resale;
• fraudulent purposes;
• abuse of a promotion; or
• circumvention of quantity restrictions.
This section does not prohibit lawful resale where such a restriction would not be enforceable under applicable law.
21. PRODUCT USE AND PET SAFETY
Customers are responsible for using products appropriately and in accordance with:
• product instructions;
• warnings;
• sizing recommendations;
• weight limits;
• intended uses;
• care information; and
• safety information.
Pet products should be used with appropriate supervision whenever reasonably necessary.
You should regularly inspect products for wear, damage, loose components, or deterioration and discontinue use where continued use may create a safety risk.
Clothing, accessories, toys, leashes, carriers, beds, feeding products, and other pet products should be used only for their stated purpose.
Products marketed for pet care or wellness are not a substitute for professional veterinary advice unless expressly stated otherwise. Follow all product-label instructions and consult a veterinarian where appropriate, particularly if your pet has a medical condition, is receiving medication, or develops an adverse reaction.
Nothing in this section excludes liability or consumer rights that cannot legally be excluded.
22. STORE AVAILABILITY
We aim to keep the Store and Services available and operating reliably.
However, access may occasionally be interrupted or restricted due to:
• maintenance;
• technical problems;
• security issues;
• provider outages;
• updates;
• events outside our reasonable control; or
• legal or regulatory requirements.
To the extent permitted by law, we do not guarantee that the Store will always be uninterrupted, continuously available, or error-free.
Interruptions to the website do not affect rights relating to orders already placed.
23. INTELLECTUAL PROPERTY
Unless otherwise stated, the original content made available through Side By Tail, including our:
• trade name;
• logo;
• branding;
• website design;
• original text;
• graphics;
• original photographs;
• videos; and
• other original content,
is owned by or licensed to Side By Tail and is protected by applicable intellectual property laws.
You may access and use the Store for personal, non-commercial purposes.
You may not reproduce, distribute, modify, publish, sell, exploit, or commercially use protected Side By Tail content without prior written permission, except where permitted by law.
Third-party trademarks, product names, supplier materials, images, and other intellectual property remain the property of their respective owners.
24. REVIEWS, FEEDBACK, AND USER CONTENT
If you submit a review, photograph, comment, suggestion, feedback, or other content, you represent that:
• you have the right to submit it;
• it reflects your honest experience or opinion;
• it does not infringe another person’s rights; and
• it does not contain unlawful or prohibited material.
You must not submit content that is:
• fraudulent or knowingly false;
• defamatory;
• threatening or abusive;
• unlawful;
• malicious;
• misleading;
• infringing of intellectual property or privacy rights; or
• unrelated spam or advertising.
To the extent permitted by law, you grant Side By Tail a non-exclusive, worldwide, royalty-free right to reproduce, display, adapt, and use content that you voluntarily submit for purposes reasonably connected with operating, improving, and promoting the Store.
This permission does not authorize us to materially misrepresent the meaning of your review or to use personal information contrary to our Privacy Policy.
We will not knowingly publish fabricated reviews or present reviews in a misleading manner.
25. THIRD-PARTY LINKS AND SERVICES
The Store may contain links to websites, applications, social media platforms, payment services, or other resources operated by independent third parties.
Side By Tail does not control independent third-party services and is not responsible for their:
• content;
• availability;
• security;
• privacy practices; or
• terms.
Your use of an independent third-party service may be subject to that third party’s own policies and terms.
Nothing in this section excludes responsibility that cannot legally be excluded.
26. PROHIBITED USES
You may not use the Store or Services:
• for unlawful or fraudulent activity;
• to violate applicable laws or regulations;
• to infringe intellectual property or privacy rights;
• to transmit malicious software or harmful code;
• to attempt unauthorized access to systems or accounts;
• to collect or misuse personal information unlawfully;
• to interfere with the security or operation of the Services;
• to submit fraudulent orders, claims, reviews, chargebacks, or return requests;
• to impersonate another person;
• to abuse promotions or payment systems; or
• to engage in conduct intended to harm Side By Tail, its customers, or its service providers.
We may restrict access, suspend activity, or cancel a transaction where reasonably necessary to prevent fraud, unlawful activity, abuse, or a security threat, subject to applicable law.
27. STATUTORY RIGHTS AND WARRANTIES
We aim to provide accurate product information and products that correspond to their descriptions.
Products remain subject to any statutory warranties, product-liability rules, and mandatory consumer protections applicable to the transaction.
Nothing in these Terms excludes or limits:
• a mandatory legal warranty;
• rights concerning defective or non-conforming products;
• rights arising from misleading information;
• product-liability rights; or
• any other consumer right that cannot lawfully be excluded or waived.
28. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Side By Tail will not be liable for indirect, incidental, special, or consequential losses arising solely from the use or inability to use the website where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability for:
• fraud or fraudulent misrepresentation;
• willful misconduct;
• gross negligence, where applicable;
• death or personal injury where liability cannot be excluded;
• defective products where liability cannot be excluded;
• breach of mandatory consumer rights; or
• any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms limits any mandatory remedy available to a consumer under applicable law.
29. RESPONSIBILITY FOR UNLAWFUL USE
To the extent permitted by applicable law, you may be responsible for reasonable losses, claims, damages, or costs directly resulting from:
• your unlawful use of the Services;
• your material violation of these Terms; or
• your infringement of another person’s rights.
This provision does not apply to the extent that the loss or claim results from an act or omission attributable to Side By Tail or where such responsibility cannot lawfully be imposed.
30. PRIVACY
Our Privacy Policy explains how personal information is collected, used, disclosed, stored, and protected.
By using the Services, you acknowledge that personal information may be processed as described in the Privacy Policy and in accordance with applicable data-protection laws.
31. ELECTRONIC COMMUNICATIONS
By placing an order or contacting us electronically, you agree that we may communicate with you electronically concerning:
• your order;
• payment;
• fulfillment;
• delivery;
• returns;
• refunds;
• customer support;
• security; and
• legal or service notices.
Transactional communications are separate from promotional communications.
You may unsubscribe from promotional emails at any time, but you may continue to receive messages required to process or service an order.
32. CHANGES TO THE SERVICES
We may update, modify, suspend, or discontinue parts of the Services where reasonably necessary.
A change to the Services will not ordinarily alter the terms of an order already accepted, except where:
• the change is requested by the customer;
• it is required by law;
• it is necessary for safety or security; or
• the customer agrees to the change.
33. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to:
• the Services;
• business practices;
• products;
• service providers;
• operational processes; or
• legal and regulatory requirements.
The updated version will be posted on the Store and the “Last updated” date will be revised.
Changes apply prospectively unless otherwise required or permitted by law.
The terms applicable to a purchase are generally those in effect when the order is placed.
34. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted, modified, or limited to the minimum extent necessary where legally possible.
The remaining provisions will continue in effect to the extent permitted by law.
35. NO WAIVER
If Side By Tail does not immediately enforce a provision of these Terms, this does not constitute a waiver of that provision or of the right to enforce it later.
A waiver is effective only where expressly confirmed in writing.
36. ENTIRE AGREEMENT
These Terms, together with our:
• Privacy Policy;
• Shipping Policy;
• Return & Refund Policy;
• product descriptions;
• product-specific conditions; and
• disclosures presented before purchase,
constitute the terms governing your use of the Services and purchases from Side By Tail, subject to applicable law.
If there is a conflict between these Terms and a more specific product disclosure presented before purchase, the more specific provision will generally apply to that product.
If there is a conflict concerning returns, refunds, shipping, or privacy, the applicable specific policy will govern that subject, subject to mandatory law.
37. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and the contractual relationship with Side By Tail are governed by the laws of Switzerland, without regard to conflict-of-law principles, except where the mandatory law applicable to the customer requires otherwise.
Nothing in these Terms deprives a consumer of mandatory protections that apply based on:
• the consumer’s place of residence;
• the destination of the order; or
• the circumstances of the transaction.
Any dispute will be submitted to a court or other authority having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to waive in advance any jurisdiction or remedy that cannot legally be waived.
